General Terms of Use

The Website offers the online shopping service, which provides a 24-hour, simple, and direct service with all the advantages of having an updated and available catalog of products from anywhere through an Internet connection.

1. Generalities

All prices are in Euros and in accordance with current regulations, any purchase made through the Website will be subject to Value Added Tax (VAT), and this amount is included in the price.

Orders destined for the Canary Islands, Ceuta and Melilla are exempt from VAT in accordance with the provisions of Article 146 of Directive 2006/112, without prejudice to the application of the corresponding taxes and duties in accordance with current regulations in each of them. Only direct orders from the online store will be served within the national mainland territory. For users residing in other areas who are interested in some of the products offered, they must contact us in advance using the contact form or by phone.

The Owner reserves the right to modify its prices at any time, but products will be invoiced based on the rates in force at the time of purchase or except for obvious typographical errors.

The Owner reserves the right to reject an order from any User with whom they have a dispute or who has had problems with the payment of previous purchases.

2. Obligations of Users

Every user who makes a purchase through this website declares to be of legal age and, if applicable, to have full capacity to use payment methods and that they have sufficient funds to cover all the costs resulting from the purchase of products. The user also declares to fully and unreservedly accept all the conditions of this legal notice.

Before placing any order, it is the obligation of the user to register beforehand on the website. The user can establish one or several requests to purchase products or services offered through the website.

When placing an order, the user accepts the specifications and characteristics of the product offered. To this effect, the owner indicates that the products shown in the photographs on this website may have slight differences with respect to the final product in terms of sizes, colors, components, etc., due to the availability of manufacturers. The purpose of the photographs is to provide guidance for the user or suggestions for presentation, without implying contractual images in any case. The owner ensures that these differences will not result in a lower quality of the products.

3. Shipping Conditions

All orders placed within the Spanish peninsula, except for the option of in-store pickup, will be shipped by courier and have a delivery time of 1 to 2 business days, if the product is in stock.

For out-of-stock products, the approximate delivery time will be 10 business days, and will be communicated to the User by email or phone.

In the event that the product is in the manufacturing process, the Owner will inform the User about the approximate delivery times, and the User may cancel the order if delivery times are exceeded.

For orders outside the Spanish peninsula, the User must contact the Owner through the contact form or by phone.

There is no minimum order required.

Order management is only done during business hours.

Orders are not delivered on weekends and holidays.

Shipping costs are specified in the shopping cart detail and may vary depending on the destination and the order.

Shipping will be free for orders with a price equal to or greater than €70, including VAT.

Additional transportation costs caused by the declaration of an incorrect or incomplete address are the absolute responsibility of the User.

The most economical option for orders will always be in-store pickup. If the User wishes to have the order delivered to their home, it will be a freely chosen option and will therefore incur an additional cost in the purchase of products.

4. Modalidades de pago y Seguridad

This payment method is immediate, totally secure, and verified by the secure servers of Redsýs in the payment gateway. Under no circumstances will credit card information be disclosed.

Only secured credit cards will be accepted to prevent any possible risk or fraud. Secured cards are associated with security keys and, at the end of the payment process, the keys must be entered into the bank’s payment gateway. If you do not have a secured card for online payments, the bank should provide the necessary information and keys.

The Owner has implemented a verification procedure to prevent fraudulent use of credit cards. As part of this audit, the User may be asked to send a copy of their ID or Passport.

5. Warranty

5.1. Manufacturer’s warranty

The warranty of the products will be that of the manufacturers, according to the current legislation of each product, indicated in the particular cases in the product description.

5.2. Authenticity guarantee

All frames and sunglasses sold by Amati Óptica Clínica are authentic and original from each of the brands they work with. The Owner works with the most relevant firms in the sector and each model for sale has its corresponding certificate of quality and authenticity, as well as the corresponding European Homologation that must certify the quality of the materials and lenses.

5.3. Satisfaction guarantee

If the order does not meet the User’s expectations, the User may request a return, and the price paid for the product would be refunded, except for the cost of shipping. See the returns policy.

If the User has any queries about warranties or needs to make a claim about any product purchased on this Website, they may contact the Owner for processing.

5.4. Aesthetic warranty in prescription glasses

During the purchase process of a prescription glasses, the User will receive the advice and recommendations that the Owner considers appropriate to achieve the glasses that best suit the User’s needs.

6. Right of withdrawal

In compliance with Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, information is provided on the User’s right of withdrawal.

6.1 When the User is a consumer and the contract is concluded without the simultaneous physical presence of the User and the Owner (distance selling), the User shall enjoy the right of withdrawal described in this section, with the exceptions provided for in Article 103.

6.2 Information to consumers and users about the right of withdrawal.

a) The User has the right to withdraw from this contract within 14 natural days without the need for justification.

b) The withdrawal period shall expire after 14 natural days from the day on which the contract is concluded.

c) To exercise the right of withdrawal, the User must notify us of their decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail or email). The withdrawal form model below may be used, although its use is not mandatory.

d) To comply with the withdrawal period, it is sufficient for the communication regarding the exercise of this right to be sent before the corresponding period expires.

e) In the event of withdrawal by the User, the Owner shall proceed to refund all payments received without undue delay and, in any event, no later than 14 natural days from the date on which we are informed of the decision to withdraw from this contract. Shipping costs will not be included if there is another more economical option offered, such as picking up the order personally by the User, who freely chooses the more expensive option, such as shipping.

f) Said refund shall be made using the same means of payment used by the User.

6.4 According to Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, in its art. 103, the right of withdrawal shall not be applicable to contracts relating to (among others):

c) The supply of goods made to the consumer’s and user’s specifications or clearly personalized.

d) The supply of goods that may deteriorate or expire rapidly.

e) The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.

Regarding this section, with the User’s order, the User gives his/her express prior consent with the knowledge on his/her part that, as a consequence, he/she loses his/her right of withdrawal.

7. Order return

A delivery will be considered made once the User signs the delivery receipt. The User will have a period of 14 calendar days to make any returns.

To be able to return the product, it must be in its original packaging and keep its labels, as well as present the same conditions as when it was sent.

Returns of scratched, incomplete, or damaged products, opened contact lens boxes, or customized products will not be accepted.

The shipping costs of returns will be borne by the User. A fixed amount of €7 for management costs will be deducted from the refund amount.

8. Availability

The available stock quantity for each item will be displayed, but a larger quantity can be requested. However, if the item is out of stock at the factory, the delivery times may be significantly longer than those established. In this case, the Owner will contact the User via email or telephone to inform them of any issues related to their order.
